1. Introduction and Acceptance of Terms
Welcome to Max Home Cash.
These Terms and Conditions (“Terms”) govern your access to and use of https://maxhomecash.com, including its webpages, online forms, content, features, communications, and related digital services (collectively, the “Website”).
The Website is owned and operated by Max Home Cash, LLC (“Max Home Cash,” “Company,” “we,” “us,” or “our”).
By affirmatively accepting these Terms through a Website form or other clearly presented acceptance mechanism, you agree to be bound by them. Your access to and use of the Website is also subject to applicable laws and regulations.
If you do not agree with these Terms, please discontinue use of the Website and do not submit information through its forms.
These Terms apply to Website activities and communications. They do not replace, modify, or supersede a separately executed real estate purchase agreement or another written contract between you and Max Home Cash.
2. About Max Home Cash
Max Home Cash is a real estate investment company specializing in acquiring residential properties, vacant land, and other real estate assets.
Our Website allows property owners and authorized representatives to request information, submit property details, inquire about potential cash offers, and explore selling opportunities.
Depending on the circumstances and applicable law, Max Home Cash may:
- Evaluate residential, commercial, and vacant properties for potential acquisition.
- Make cash purchase offers based on property-specific information.
- Acquire properties directly or through an identified affiliated or designated purchasing entity.
- Coordinate property evaluations, inspections, title examinations, and closing arrangements.
- Work with title companies, escrow agents, attorneys, contractors, and other transaction professionals.
- Consider alternative transaction structures where lawful and appropriately disclosed.
Unless expressly established through a separate written agreement, Max Home Cash acts as a prospective real estate purchaser or investor and does not represent a property owner as their real estate broker or agent.
Any required licensing, agency disclosures, purchaser disclosures, or other regulatory obligations remain applicable regardless of these Terms.
Availability of our services may vary by location, property type, market conditions, and applicable law.
3. Eligibility and Authority
By submitting information or initiating a property-related inquiry through the Website, you represent that:
- You are at least 18 years old and have the legal capacity to enter into applicable agreements.
- Information you provide is accurate and submitted for a legitimate purpose.
- If you represent yourself as a property owner, you have an ownership interest in the property or a lawful basis for making that representation.
- If acting for another individual or entity, you possess appropriate authorization to act in that capacity.
- You will not impersonate another person or misrepresent your authority to sell, transfer, or otherwise transact concerning real property.
- You will comply with applicable laws when using the Website.
Submitting an inquiry on behalf of a trust, estate, corporation, limited liability company, or another legal entity does not establish your legal authority to execute a property transaction.
Max Home Cash reserves the right to request reasonable documentation verifying ownership, identity, legal capacity, and transaction authority before proceeding.
4. Website Services and Property Inquiries
The Website provides a platform for requesting information and initiating discussions concerning potential real estate transactions.
You may submit information regarding property location, condition, occupancy, ownership, estimated value, and your preferred transaction timeline.
Submitting an inquiry does not:
- Require you to sell your property.
- Require Max Home Cash to purchase your property.
- Guarantee that an offer will be made.
- Establish an agreed purchase price.
- Create a real estate purchase contract.
- Create an agency, fiduciary, partnership, or employment relationship.
- Guarantee approval of a particular transaction structure.
- Obligate either party to complete a real estate transaction.
Initial consultations and requests for purchase offers submitted through the Website are free and do not obligate you to accept an offer.
Max Home Cash may accept, decline, or discontinue consideration of a property inquiry, subject to applicable law and any existing contractual obligations.
5. Cash Offers, Estimates, and Property Valuations
Information presented on the Website concerning cash offers, property values, potential proceeds, or acquisition opportunities is provided for preliminary informational purposes.
A preliminary price indication, verbal discussion, online estimate, or proposed cash offer does not automatically constitute a legally enforceable agreement.
Potential purchase prices may be determined using factors including:
- Property location and prevailing market conditions.
- Comparable property sales and market activity.
- Structural condition and anticipated repair requirements.
- Occupancy, tenancy, and possession matters.
- Property size, configuration, and intended use.
- Zoning, restrictions, and development considerations.
- Existing mortgages, liens, judgments, taxes, and assessments.
- Title status and ownership documentation.
- Transaction expenses and projected investment risks.
- Other information relevant to the proposed acquisition.
Online estimates and preliminary valuations are not certified appraisals and should not be interpreted as guarantees of market value.
A proposed purchase price or transaction structure may be evaluated or revised before execution of a binding purchase agreement. Once an agreement is executed, any modification must comply with that agreement and applicable law.
Nothing in these Terms authorizes Max Home Cash to disregard a binding written offer, executed contract, or obligation imposed by applicable law.
6. No Obligation to Accept an Offer
Requesting or receiving a cash offer through Max Home Cash does not obligate a property owner to sell.
You remain free to evaluate the proposed terms, consult independent professionals, seek competing offers, or decline to proceed before becoming contractually bound.
Max Home Cash does not charge a fee merely for requesting or declining a preliminary cash offer through the Website.
If you subsequently execute a real estate purchase agreement, your rights and obligations, including any rights to cancel or terminate, will be governed by that agreement and applicable law.
7. Real Estate Purchase Agreements
All actual property acquisitions are subject to applicable contractual requirements and real estate laws.
A real estate transaction becomes binding only when the parties have entered into an enforceable agreement satisfying applicable legal requirements.
Any purchase agreement may address:
- Identification of the seller, buyer, and property.
- Purchase price and payment terms.
- Earnest money or deposit requirements.
- Property condition and inspection rights.
- Title examination and ownership requirements.
- Closing arrangements and deadlines.
- Allocation of closing costs.
- Existing liens and financial obligations.
- Contingencies and termination rights.
- Assignment rights, if applicable.
- Representations, warranties, and disclosures.
- Remedies in the event of a contractual breach.
If a provision of these Website Terms conflicts with a separately executed purchase agreement concerning the property transaction, the purchase agreement controls that transaction.
These Website Terms do not grant either party additional rights to cancel, assign, modify, or avoid performance under an executed real estate contract.
8. Property Condition and As-Is Transactions
Max Home Cash considers properties in various conditions, including properties requiring significant repairs, rehabilitation, or renovation.
Properties may be evaluated for purchase in their existing condition, commonly described as an “as-is” transaction.
The specific meaning and legal effect of an as-is purchase will depend on the applicable purchase agreement and governing law.
An as-is transaction does not automatically eliminate a seller’s statutory disclosure obligations, excuse fraud or intentional misrepresentation, or waive other rights that cannot lawfully be waived.
Any representations concerning property condition, inspections, repairs, or seller responsibilities will be governed by the executed agreement and applicable law.
9. Transaction Timelines and Closing Dates
Max Home Cash may offer expedited acquisition opportunities, including transactions that can close in approximately 14 days under suitable circumstances.
However, actual closing timelines depend on the specific property and transaction.
Potential factors affecting completion include:
- Title examination and clearance.
- Mortgage payoff information.
- Lien resolution.
- Ownership verification.
- Probate or estate administration.
- Required third-party approvals.
- Inspections and due diligence.
- Escrow and settlement procedures.
- Contractual contingencies.
- Governmental requirements.
- Other circumstances affecting legal or practical completion.
References to same-day offers, expedited closings, or flexible closing dates describe potential service capabilities and do not guarantee a particular result in every transaction.
Binding deadlines and closing obligations are determined by the executed purchase agreement.
10. Fees, Commissions, and Closing Expenses
Max Home Cash does not charge property owners a fee to submit a Website inquiry, request a consultation, or receive a preliminary cash offer.
Our direct-purchase process is generally structured to eliminate traditional seller-side real estate commissions payable to Max Home Cash.
However, pre-existing financial obligations associated with a property may remain payable, including mortgage balances, delinquent property taxes, judgments, liens, assessments, or other legally enforceable obligations.
The allocation of closing expenses and transaction costs will be specified in the applicable purchase agreement and settlement documentation.
Any promise concerning the payment or waiver of particular costs must be honored according to the applicable written agreement and law.
Nothing in these Terms creates an undisclosed charge or overrides an express written commitment made by Max Home Cash regarding fees or closing costs.
11. Ownership, Property Information, and Verification
You agree not to knowingly submit materially false or misleading information concerning a property or your authority to transact.
Max Home Cash may, where lawful and reasonably related to a legitimate property inquiry, verify information using:
- Public property and tax records.
- Recorder and assessor records.
- Title and ownership documentation.
- Available property records and market data.
- Information voluntarily provided by owners or authorized representatives.
- Lawfully obtained third-party property information.
- Inspections or evaluations authorized by an appropriate party.
You are not required to provide sensitive documents merely to browse the Website or request general information.
Additional documentation may be requested when reasonably necessary for due diligence, identity verification, fraud prevention, or a proposed transaction.
Any inspection or physical entry onto private property requires appropriate legal authorization or consent.
12. Third-Party Professionals and Transaction Participants
Real estate transactions may require participation from independent service providers, including title companies, escrow agents, attorneys, inspectors, contractors, and settlement professionals.
These parties may operate independently and may be subject to their own professional obligations, contracts, and privacy practices.
Where appropriate and lawful, Max Home Cash may share relevant transaction information with parties reasonably necessary to evaluate, document, or complete a requested transaction, consistent with the Company’s Privacy Policy and applicable law.
Max Home Cash may also conduct transactions through an identified affiliated or designated purchasing entity when permitted by the applicable agreement and law.
Any contractual assignment, transfer of purchase rights, or participation by another purchaser remains subject to the applicable purchase agreement, required disclosures, and governing law.
These Terms do not independently authorize the assignment of an executed real estate purchase agreement.
13. Foreclosure, Probate, Inheritance, and Other Special Circumstances
The Website may provide information regarding properties affected by foreclosure, inheritance, probate, divorce, bankruptcy, tax obligations, or other circumstances.
Such information is general in nature and does not constitute legal, tax, financial, foreclosure-defense, or estate-planning advice.
A potential cash purchase may provide an available transaction option, but Max Home Cash does not guarantee that a proposed sale will prevent foreclosure, resolve an estate dispute, eliminate legal obligations, or produce a particular financial outcome.
Property owners should obtain appropriate independent advice when legal rights, deadlines, creditor claims, ownership disputes, or court approval requirements are involved.
Max Home Cash will not represent itself as having authority to suspend foreclosure proceedings, release liens, or resolve legal matters unless that authority has been lawfully established.
14. Communications and Contact Authorization
By contacting Max Home Cash or submitting a property inquiry, you authorize us to respond concerning your request through contact information you lawfully provide.
Communications may include:
- Responses to property inquiries.
- Follow-up questions about property information.
- Consultation and appointment scheduling.
- Potential purchase offers.
- Due diligence and transaction coordination.
- Requested property-related updates.
- Customer service and administrative communications.
Communications may occur through telephone calls, email, text messages, or other methods permitted by applicable law.
Providing contact information for an inquiry does not, by itself, constitute blanket authorization for all forms of promotional, automated, prerecorded, or artificial-voice marketing.
Where separate consent is legally required, Max Home Cash will seek that consent before initiating the applicable communications.
You represent that the contact information you submit belongs to you or that you are otherwise authorized to provide it.
You may request that Max Home Cash stop contacting you for marketing purposes, subject to legally permitted transactional or administrative communications.
15. SMS and Text Messaging Terms
15.1 Consent to Receive Messages
If you voluntarily enroll in an SMS program offered by Max Home Cash, you consent to receive text messages within the scope of the consent you provide.
Depending on your enrollment, messages may include property inquiries, appointment reminders, offer updates, transaction information, and promotional communications.
Marketing text messages requiring prior express written consent will be sent only when the applicable consent requirements have been satisfied.
Consent to receive marketing messages is voluntary and is not required to request a cash offer, enter into a purchase agreement, or otherwise obtain services from Max Home Cash.
15.2 Message Frequency
Message frequency varies according to your inquiries, interactions, subscriptions, and transaction activity.
15.3 Message and Data Rates
Standard message and data rates may apply according to your wireless service provider and mobile plan.
Max Home Cash does not control charges assessed by wireless carriers.
15.4 Opt-Out
You may withdraw your consent to receive text messages at any time by replying STOP or using another reasonable opt-out method permitted by applicable law.
Max Home Cash will honor legally effective revocation requests within the time required by applicable law.
You may receive a single confirmation message acknowledging your opt-out where permitted.
15.5 Assistance
For assistance with text messaging, reply HELP to a message or contact:

15.6 Privacy of Mobile Information
Mobile telephone numbers, SMS opt-in information, and messaging consent records will not be sold or shared with third parties or affiliates for their independent marketing or promotional purposes.
Service providers assisting with lawful message delivery may process necessary information solely to provide those services, subject to appropriate restrictions and applicable law.
15.7 Message Delivery
Wireless carriers and messaging providers may affect the timing or successful delivery of communications.
Max Home Cash cannot guarantee uninterrupted delivery of SMS messages.
Nothing in this section limits rights or remedies available under applicable telecommunications or consumer protection laws.
16. Email and Electronic Communications
By contacting Max Home Cash electronically, you acknowledge that we may respond electronically when appropriate.
You are responsible for maintaining accurate contact details and notifying us of relevant changes.
Where permitted by law and agreed to by the applicable parties, electronic signatures, electronic records, and electronically delivered documents may be used in connection with certain transactions.
Electronic communications do not automatically replace any notarization, recording, physical signature, disclosure, or other formality required by applicable real estate law.
Any legally required consumer consent to electronic records will be obtained separately when applicable.
You may opt out of promotional emails by following the unsubscribe instructions provided or contacting Max Home Cash directly.
17. Privacy and Information Protection
Your privacy is important to Max Home Cash.
Our collection, use, retention, and disclosure of personal information are addressed in our Privacy Policy:
https://maxhomecash.com/privacy
Depending on your interactions with the Website, information may include:
- Name and contact information.
- Property addresses and property details.
- Information submitted through Website forms.
- Transaction-related information.
- Technical information concerning Website access.
- Information reasonably necessary to process your requests.
The Website may use cookies, analytics technologies, and similar tools as described in our Privacy Policy.
Any required notices, consent choices, or privacy rights under applicable federal or state law will be respected.
These Terms do not constitute an independent waiver of any statutory privacy rights.
If the Privacy Policy and these Terms address different aspects of personal information processing, the Privacy Policy governs the Company’s disclosed privacy practices, subject to applicable law.
18. User Submissions and Content
You may submit property descriptions, photographs, documents, comments, or other materials through the Website.
You represent that you have the right to provide the submitted materials and that doing so does not violate another person’s rights or applicable law.
You retain ownership of materials you lawfully submit.
By submitting materials, you grant Max Home Cash a nonexclusive, limited permission to access, review, store, reproduce, and share those materials as reasonably necessary to evaluate your inquiry, communicate with you, perform requested services, and facilitate a contemplated transaction, consistent with the Privacy Policy and applicable law.
This permission does not authorize the public advertising or publication of your private property photographs, personal documents, or identifying information without an appropriate legal basis or authorization.
Max Home Cash may remove or decline submissions that violate these Terms or applicable law.
19. Prohibited Website Activities
You agree not to use the Website for unlawful, fraudulent, or unauthorized purposes.
Prohibited activities include:
- Providing knowingly false or fraudulent information.
- Impersonating property owners, employees, or authorized representatives.
- Submitting another person’s private contact information without authorization.
- Attempting unauthorized access to Website systems or information.
- Introducing malware, harmful code, or security threats.
- Interfering with Website functionality or availability.
- Using automated tools to improperly collect Website data or overwhelm Website infrastructure.
- Reproducing substantial Website content without permission or another lawful basis.
- Using the Website to harass, threaten, defraud, or exploit others.
- Violating applicable intellectual property, privacy, consumer protection, or other laws.
Max Home Cash reserves the right to restrict access, remove harmful submissions, investigate suspected misuse, and pursue lawful remedies when reasonably necessary.
20. Intellectual Property Rights
The Website and its original content, including its design, layout, text, graphics, branding, photographs, software, and other protected materials, are owned by Max Home Cash or their respective rights holders.
The Max Home Cash name, branding, and associated identifiers may be protected under applicable trademark and unfair competition laws.
You receive a limited, revocable, nonexclusive permission to access and use the Website for lawful personal or business inquiries consistent with these Terms.
Except as permitted by law or authorized in writing, you may not reproduce, distribute, commercially exploit, modify, or create derivative works from protected Website content.
Nothing in these Terms transfers ownership of intellectual property to Website visitors.
Third-party trademarks, names, logos, and other materials remain the property of their respective owners.
21. Third-Party Websites and External Resources
The Website may contain links to third-party websites, informational resources, mapping services, or other external platforms.
These resources are provided for convenience or informational purposes.
Unless expressly stated, inclusion of a third-party link does not establish sponsorship, endorsement, ownership, or control by Max Home Cash.
Third parties may maintain independent terms, privacy policies, and operational practices.
Max Home Cash is not responsible for independently operated third-party services or their acts and omissions, except to the extent liability is imposed by applicable law.
You should review applicable third-party terms before providing sensitive information or entering into transactions through external platforms.
22. Accuracy of Website Information
Max Home Cash strives to maintain accurate and useful Website information.
However, real estate markets, property conditions, legal requirements, and available transaction opportunities may change.
Website content may occasionally contain typographical errors, outdated information, incomplete descriptions, or technical inaccuracies.
Max Home Cash may update or correct Website information as appropriate.
General information, illustrative examples, and descriptions of potential transaction outcomes should not be interpreted as guarantees.
Nothing in this section authorizes materially false or misleading advertising or excuses representations that are legally binding.
23. Website Availability and Modifications
Max Home Cash may update, improve, suspend, or discontinue Website features or services when reasonably necessary.
The Website may become temporarily unavailable because of maintenance, security incidents, technical interruptions, or circumstances beyond our reasonable control.
We do not guarantee uninterrupted or error-free access.
We may implement reasonable security controls to protect Website users and Company systems.
Any changes affecting an existing contractual property transaction remain subject to the executed agreement and applicable law.
24. Disclaimer of Website Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ITS GENERAL INFORMATIONAL CONTENT ARE PROVIDED ON AN “AS AVAILABLE” AND “AS IS” BASIS.
MAX HOME CASH DISCLAIMS IMPLIED WARRANTIES RELATING TO WEBSITE PERFORMANCE, AVAILABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE EXTENT SUCH DISCLAIMERS ARE LAWFUL.
WE DO NOT WARRANT THAT THE WEBSITE WILL ALWAYS OPERATE WITHOUT INTERRUPTION, ERROR, OR UNAUTHORIZED INTERFERENCE.
THIS DISCLAIMER APPLIES TO THE WEBSITE AND DOES NOT NEGATE EXPRESS WARRANTIES, CONTRACTUAL COMMITMENTS, STATUTORY OBLIGATIONS, OR LEGALLY PROTECTED RIGHTS ARISING UNDER A SEPARATE REAL ESTATE PURCHASE AGREEMENT.
NOTHING IN THESE TERMS EXCLUDES WARRANTIES OR REMEDIES THAT CANNOT LAWFULLY BE DISCLAIMED.
25. Limitation of Liability
To the maximum extent permitted by applicable law, Max Home Cash and its officers, managers, employees, and authorized representatives will not be liable for indirect, incidental, special, exemplary, or consequential damages arising solely from Website operation, interruption, or ordinary Website use where such damages may lawfully be excluded.
For claims arising solely from Website services, and not from an executed property transaction or another separate agreement, the Company’s aggregate contractual liability will not exceed the greater of:
- The amount you paid directly to Max Home Cash for the applicable Website service during the preceding 12 months; or
- One hundred United States dollars ($100).
This limitation does not apply to the extent prohibited by applicable law, including liability that cannot lawfully be excluded or limited for fraud, intentional misconduct, certain statutory violations, personal injury, or other protected claims.
These Terms do not limit remedies available under a separately executed real estate purchase agreement.
26. Indemnification
To the extent permitted by law, you agree to indemnify Max Home Cash against reasonable third-party claims, losses, and expenses arising directly from:
- Your intentional misuse of the Website.
- Your fraudulent or knowingly unlawful conduct.
- Your infringement of another person’s intellectual property rights.
- Your submission of materials that you knowingly lack authority to provide.
- Your material violation of these Terms resulting in harm to a third party.
This provision does not require you to indemnify Max Home Cash for the Company’s own negligence, unlawful conduct, breach of contract, or other liability where such indemnification is prohibited by law.
27. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT DESCRIBES RIGHTS CONCERNING ARBITRATION AND THE RESOLUTION OF CERTAIN WEBSITE-RELATED DISPUTES.
27.1 Scope
This section applies only to disputes arising from or relating to these Website Terms, Website use, Website-submitted inquiries, or associated communications.
It does not govern disputes arising under a separately executed real estate purchase agreement or another written transaction agreement unless that agreement independently and expressly incorporates this dispute-resolution provision.
27.2 Informal Resolution
Before commencing formal proceedings, either party may provide written notice describing the dispute and requested resolution.
The parties agree to attempt a good-faith informal resolution for 30 days following receipt of sufficient notice.
This requirement does not prevent either party from seeking emergency relief, pursuing a qualifying small-claims action, or exercising rights that cannot lawfully be conditioned on informal negotiation.
27.3 Individual Arbitration
Except as otherwise provided in this section, disputes covered by this arbitration agreement that cannot be resolved informally will be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its applicable Consumer Arbitration Rules and Mediation Procedures.
The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement to the extent applicable.
The arbitrator may award any individual remedy available under applicable substantive law that a court could award.
Arbitration shall be conducted through documents, telephone, video conference, or an appropriate physical location consistent with the applicable AAA rules and consumer protections.
27.4 Arbitration Costs
Administrative expenses, filing fees, and arbitrator compensation will be allocated according to the applicable AAA Consumer Arbitration Rules, fee schedule, and governing law.
Max Home Cash will pay those arbitration costs that a business is required to pay under the applicable rules and law.
Nothing in these Terms requires a consumer to pay arbitration fees prohibited by applicable law or greater fees than permitted under the applicable consumer rules.
27.5 Exceptions
Either party may bring an eligible individual claim in small-claims court.
Nothing in this provision prevents a party from seeking relief before an appropriate governmental authority or exercising a right to judicial relief that cannot lawfully be waived.
Claims for public injunctive relief or other remedies that applicable law requires to remain available in court will not be barred by this arbitration provision.
27.6 Class and Representative Proceedings
To the extent permitted by law, disputes subject to arbitration will be pursued on an individual basis rather than through class or collective arbitration.
This provision does not prohibit representative proceedings or public remedies where applicable law makes such a restriction unenforceable.
If the class or representative proceeding restriction is found unenforceable with respect to a particular claim or remedy, that claim or remedy shall proceed in an appropriate court to the extent legally required.
27.7 Right to Opt Out
You may opt out of this arbitration provision within 30 days after first affirmatively accepting these Terms.
To opt out, send an email to info@maxhomecash.com with the subject line “Arbitration Opt-Out.”
Include your name, email address, and a statement that you elect not to participate in the Website Terms arbitration agreement.
Opting out does not affect your ability to use the Website or request a cash offer.
If you validly opt out, disputes will proceed in an appropriate court rather than under this arbitration provision.
27.8 Changes to Arbitration Terms
Material changes to this arbitration provision will not apply retroactively to disputes that arose before the change where prohibited by law or without any legally required consent.
If the designated arbitration administrator declines to administer a dispute, the parties may select a mutually acceptable alternative administrator. If no lawful alternative is available, the dispute may proceed before a court of competent jurisdiction.
28. Governing Law and Jurisdiction
Except where federal law or mandatory state law provides otherwise, these Website Terms are governed by the laws of the State of Nevada, without applying conflict-of-law principles that would require application of another jurisdiction’s law.
For Website-related disputes not subject to enforceable arbitration, the parties consent to the jurisdiction of the appropriate state or federal courts serving Clark County, Nevada, to the extent permitted by applicable law.
This provision does not deprive consumers of mandatory protections or courts that applicable law requires to remain available.
Real estate purchase agreements involving property in another state may be governed by that state’s applicable law and the governing-law provisions of the relevant agreement.
29. Changes to These Terms
Max Home Cash may revise these Terms to reflect changes in Website functionality, business practices, or legal requirements.
Updated Terms will be published on the Website with a revised effective or last-updated date.
Where required by law, material changes will be communicated through additional notice or an affirmative acceptance process.
Continued use following effective notice of updated Terms may constitute acceptance to the extent legally permitted.
Changes will not retroactively modify existing rights or obligations where prohibited by law.
Executed real estate purchase agreements remain governed by their own terms and applicable law.
30. Termination and Restricted Access
Max Home Cash may suspend or restrict Website access when reasonably necessary to address unlawful activity, security threats, fraudulent submissions, or material violations of these Terms.
You may discontinue Website use at any time.
Termination of Website access does not automatically terminate a separately executed real estate purchase agreement or eliminate obligations that lawfully survive.
Provisions concerning intellectual property, appropriate liability limitations, dispute resolution, and other provisions intended by their nature to survive may remain effective after Website use ends.
31. Severability
If any provision of these Terms is held invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
An invalid provision will be enforced only to the lawful extent, if permissible, without altering the essential purposes of these Terms.
The specific severability provisions concerning arbitration and class proceedings will apply to those matters as stated in Section 27.
32. No Waiver
Failure by Max Home Cash to enforce a provision of these Terms on a particular occasion does not constitute a permanent waiver of that provision or any other lawful right.
Any waiver must be valid under applicable law and will apply only to the specific circumstances for which it is given.
33. Entire Agreement and Order of Precedence
These Terms, together with the Privacy Policy and any expressly incorporated Website notices or supplemental terms, govern use of the Website.
They do not constitute the entire agreement for an actual property sale.
A separately executed real estate purchase agreement and its valid amendments control the respective parties’ rights and obligations concerning that property transaction.
Nothing in these Terms modifies the rights of third parties under an existing contract or applicable law.
34. Relationship of the Parties
Use of the Website does not create an employment relationship, joint venture, partnership, brokerage representation, fiduciary relationship, or other agency relationship between you and Max Home Cash.
A different relationship may arise only through applicable law or a valid separate agreement establishing that relationship.
Max Home Cash’s communications as a potential purchaser should not be interpreted as independent legal, tax, financial, or real estate brokerage representation of the seller.
35. Accessibility and Customer Assistance
Max Home Cash seeks to make its Website and property inquiry process accessible to individuals with varying needs.
If you experience difficulty accessing Website information or submitting a property inquiry, please contact us using the information below.
We will make reasonable efforts to provide assistance and address accessibility concerns consistent with applicable law.
